The following describes the terms on which eSkinStore - eSkinCareStore offers you access
to our services and online product ordering.
1.1 Indemnifications by customer. Customer agrees to indemnify, defend and hold eSkinStore - eSkinCareStore, it's owners and employees, harmless from and against any and all losses, claims, demands, damages, liabilities, costs and expenses, including but not limited to reasonable attorney's fees and costs of suit arising out of our Customer's use of services provided to you by eSkinStore - eSkinCareStore. Such indemnification shall include, but not be limited to, loss of data, claims for libel, slander, infringement of copyright, theft of misappropriation of intellectual property, or unauthorized use of any trademark, trade name, or service mark.
1.2 Indemnification by eSkinCareStore. Except as otherwise herein provided, eSkinStore - eSkinCareStore agrees to indemnify, defend and hold Customer harmless from and against any and all losses, claims, demands, damages, liabilities, costs of suit (but excluding consequential damages) arising from NatureSkinStore - eSkinCareStore gross negligence in the course of providing service under this agreement.
2) Shippment of Orders:
eSkinStore - eSkinCareStore supplies products Only under these terms and conditions:
2.1. Customer (Shopper) accepts full liability for the use of all products and services supplied by eSkinStore - eSkinCareStore. The Customer (Shopper) vows they will only use products under the guidance of their Esthetician.
2.2.. The Customer (Shopper) is completely responsible for the confirmation of their personal importation requirements. Products are not available where prohibited by law.
2.3 The Customer (Shopper) confirms they are of legal age.
2.4. eSkinStore - eSkinCareStore is not responsible for delays caused by reasons beyond its control, But will provide tracking and assistance in such cases. However the Customer (Shopper) must wait for a period of 4 weeks after the ship date indicated on the dispatch note. In the event of a claim under the registered service, the tracking process can take up to 6 weeks, whereupon a confirmed mailing loss will result in the products being shipped for a second and final time.
2.5. If eSkinStore - eSkinCareStore has shipped the wrong products, or products have arrived in a damaged condition due to incorrect packaging. The package and products must be returned to eSkinStore - eSkinCareStore for inspection by contacting eSkinStore - eSkinCareStore before undertaking any action. If the fault is identified and agreed, Naturally Yours Skin Care will reship the products a second and final time. Should a refund or part refund be required they are subject to the conditions in section 4.4.
2.6. eSkinStore - eSkinCareStore only guarantees a delivery if Customer (Shopper) has requested and paid for a "Registered Shipping Method".
2.7. eSkinStore - eSkinCareStore skin Consultation tips are for customer information purposes and, all information is supplied on an educational basis and does not in anyway replace that of a physician's.
2.8. eSkinStore - eSkinCareStore reserves the right to alter methods of shipments or to refuse orders as it sees fit.
3) Information Acquired:
All information and contents thereof obtained using eSkinStore - eSkinCareStore Services and Products and Skin Care tips and advices is the sole responsibility of the customer. eSkinStore - eSkinCareStore, it's owners or employees, will not be held responsible for any damages you or another party suffer as a result of our services and products. Transmission of any material in violation of any Canada and U.S., state or local regulation is strictly prohibited.
4.1. If the Customer (Shopper) requests a change in an order before the products are shipped then changes can be made. If the Customer (Shopper) wishes to receive a part refund then it is subject to the conditions in section 4.2.
4.2.. If the Customer (Shopper) wants to stop or change an order after payment has been processed but before the goods have been shipped, it is subject to a 5% charge on credit cards.
4.3. If (Customer (Shopper)wish to cancel orders with eSkinStore - eSkinCareStore before shipment of products, She/He required to give written notice by e-mail. Canceling does not relieve you of liability for any outstanding funds which covers up to 10% of cost of package, included within is the restocking fee, processing fee, shipping and taxes. The same applies to International Orders.
4.4. NO RETURN WILL BE ACCEPTED AFTER THE PRODUCTS ARE SHIPPED
The customer may ask to try the samples first before purchasing a products, so that they can see if there is any allergic reactions to their skin.
5) Interruptions; Discontinuances:
eSkinStore - eSkinCareStore is not, and will not be responsible for interruptions or discontinuances of service caused by factors beyond it's control, including, but not limited to equipment failure, delays, negligence, strikes, or acts of God.
These Terms of Service supersede all prior and contemporaneous agreements or understandings, inducements or conditions, expressed or implied, between eSkinStore - eSkinCareStore and the customer(s). eSkinStore - eSkinCareStore reserves the right to change it's rates and/or modify these Terms of Service without any notice.
All orders from Canada are subject to 5% GST.
All orders from British Columbia are subject to an additional 12% HST.
All orders from Ontario are subject to an additional 13% HST.
eSkinStore - eSkinCareStore is a registered company in both United States (Washington State) and Canada (British Columbia).
